Legal Agreement for the provision of the Safety Trip Plan Service ("Agreement"):

The following are terms of a legal agreement between you and Float Plan Registration Inc., providers of the Safety Trip Plan service. Where Safety Trip Plan is referred to below, it is by extension referring to Float Plan Registration Inc., a not-for-profit corporation federally registered in the country of Canada. By clicking on the rules and regulations box upon registration, you acknowledge that you have read, understood, and agree, to be bound by all applicable laws and regulations and to the following terms:

1. I hereby authorize Safety Trip Plan to store, by electronic or other means, the personal information I supply here, as well as personal information I supply when filing Safety Trip Plans in the future. I authorize Safety Trip Plan to retain this information until such time as I notify them in writing that I wish to terminate this agreement, at which time I authorize Safety Trip Plan to delete all personal information I supply here.
    
2. In the event I become "overdue" after filing a Safety Trip Plan, I hereby request Safety Trip Plan to contact the appropriate authorities on my behalf. Any actions taken by Safety Trip Plan to locate me should I become overdue should be considered by all authorities as a personal request by me to provide assistance to me, and all authorities should consider Safety Trip Plan as my agent in this regard.
    
3. I acknowledge that Safety Trip Plan is a safety contact service, is not a rescue agency, and is acting solely on my direction.
    
4. I understand that Safety Trip Plan will make every reasonable effort to contact both me, and the appropriate authorities, should I become overdue or fail to cancel any Safety Trip Plan that I may file.
    
5. I understand that Safety Trip Plan is not liable for (a) any personal harm I may suffer, or (b) any damage to my vehicles or other personal property as a result of my being considered overdue, and hold Safety Trip Plan free from harm in all regards.
    
6. I accept full responsibility for any additional costs to local law enforcement, fire, ambulance, coast guard, or other authorities or agencies that may be incurred as a result of the actions of Safety Trip Plan to attempt to assist me should I be overdue or should I fail to cancel any Safety Trip Plans I file through this service.
    
7. I understand that the cost is $45 annually, plus $7.50 one-time activation fee at time of joining, and includes myself and all immediate family resident at my primary address and using the same telephone number. We can all store our individual medical information and we may also list our vehicles and equipment.
    
8. I understand that, should I need to change any of the information I have provided to you regarding any of my personal contact information (including the location of my residence, telephone numbers, etc.) as well as personal or vehicular information associated with immediate family residents of my address, changes are not charged for.
    
9. By immediate family resident, we mean a person who is directly related to you by blood, marriage, or common-law marriage whose primary residence is at your home address and is under the age of 18 years, or any other person who is directly related to you by blood, marriage, or common-law marriage who declares your home address as the address of their legal domicile: and using the same telephone number.
    
10. Unless I advise Safety Trip Plan otherwise, I understand that the most recent information contained within the Safety Trip Plan database will be taken as correct. There are no administrative costs.
     
11. I understand that my failure to provide updated personal information to Safety Trip Plan does not constitute a breach of contract with Safety Trip Plan - however, I also understand that Safety Trip Plan can only take actions to contact me, or the authorities, based on the most recent information I have provided to them.
     
12. I understand that the failure by me or any other immediate family resident to cancel an outstanding Safety Trip Plan will result in the following:
1. On first offence, if I/we are discovered to be safe and not requiring assistance, Safety Trip Plan will issue me a verbal and written warning regarding abuse of the service.
    
2. On second offence, if I/we are discovered to be safe and not requiring assistance, Safety Trip Plan will issue me a Second verbal and written warning regarding abuse of the service.
    
3. On third offence, if I/we are discovered to be safe and not requiring assistance, Safety Trip Plan will advise the member if they want to stay in the system, we will require a security deposit to cover the costs of the Search Center's unnecessary telephone calls that they are incurring. The deposit will be determined by the Search Center based on past expenses for this member.
13. In any event, should I fail to cancel any Safety Trip Plan I file with this service, I agree to be bound by the terms and conditions of paragraph 6 as stated above, including accepting fiduciary responsibility for any additional costs as identified in paragraph 6, or as otherwise incurred by Safety Trip Plan or Float Plan Registration Inc. in their efforts to locate me and/or determine that I am safe.
     
14. For any correspondence sent to Safety Trip Plan via regular mail, please allow 4-6 weeks for delivery before contacting Safety Trip Plan for status or further information regarding your request.
     
15. Safety Trip Plan reserves the right to cancel this agreement with you at any time, upon refunding your $45 registration fee and providing you with proper notification of the termination of our service for any reason, except in the cases of registrants who fail to cancel outstanding Safety Trip Plans as outlined in paragraph 12 above.
     

IN NO EVENT WILL FLOAT PLAN REGISTRATION BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES FOR ANY USE OF THIS SERVICE, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF LIFE, LOSS OF PERSONAL PROPERTY, LOST PERSONAL INCOME, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALL INFORMATION IS PROVIDED BY FLOAT PLAN REGISTRATION INC. ON AN "AS IS" BASIS ONLY. FLOAT PLAN REGISTRATION INC. PROVIDES NO REPRESENTATIONS, WARRANTIES, AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES AND CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NONINFRINGEMENT.

Safety Trip Plan may at any time revise these terms by updating this document and posting it on this web site. By clicking the rules and regulations box upon registering, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current terms to which you are bound.
